Terms of Sale for Digital Seamless Designs and PNGs
Thank you so much for supporting my designs! Please take a moment to read through the following terms before purchasing:
1. Digital Products
Unless specified otherwise, all items are digital files only, no physical products will be sent. Files will be delivered via email in a downloadable link after purchase.
2. Exclusive & Non-Exclusive Designs
- Exclusive colourways are sold to one customer only and will not be resold in that colour variation. Exclusivity applies to the colourway unless otherwise stated.
- Non-exclusive designs may be sold to multiple customers and are priced accordingly.
- Limited colourways and PNGs are sold in a limited number (e.g. a design may be available to 3 people per colourway or PNG)
3. Usage
You may use my designs to create physical products for both personal and commercial use. The digital files themselves must not be resold, shared or redistributed in any form.
4. Third Party Printing (Including Bamboo Fabric)
Use of my designs for bamboo fabric products is allowed. When working with any third party printer, it is your responsibility to ensure they are reputable and respect design ownership. Files should be provided for the sole purpose of fulfilling your order and must not be retained, reused or shared. I am not responsible for any misuse by third party printing companies.
5. PNG & Design Use
PNG elements and designs may not be used to create new seamless patterns or digital designs for resale or distribution.
6. Modifications
Designs must not be altered or modified without my permission.
7. Copyright & Licensing
All designs remain the copyright of Sharny Day Designs. Your purchase grants you a non-transferable licence to use the design as outlined above.
8. Refunds
Due to the nature of digital products, all sales are final. Refunds will only be issued in the case of a genuine technical issue.
9. Restocks and New Colourways
I will not restock any sold out files, such is the exclusivity of my files. Once they are gone, they are gone. If you would like to purchase an available file but in an alternative colourway, I can provide colour/background changes on available files, please reach out to arrange this before purchasing the file.
10. Reps & Handmade Businesses
If a rep purchases or gifts a design to a handmade business, the licence transfers to that business once the file has been sent. The initial transfer from the rep to the intended business is permitted and does not count as redistribution.
Once transferred, the design belongs to that business and must not be shared, gifted or transferred to anyone else. This includes exclusive colourways, where the receiving business becomes the exclusive licence holder.
If a rep wishes to keep ownership of a design and simply have a handmade business create a one-off item for personal use, this must be made clear before the file is shared. In this case, the design remains the rep's and may only be used for that specific item.
